Pyramid Flooring Systems Limited Warranty

PYRAMID FLOORING SYSTEMS WARRANTS TO ITS OWNER OCCUPIED, RESIDENTIAL CUSTOMERS, AND NO ONE ELSE, THE QUALITY OF WORKMANSHIP OF THE ORIGINAL INSTALLATION PERFORMED BY COMPANY AND ITS AUTHORIZED INSTALLERS (“INSTALLER(S)”) TO BE CONSISTENT WITH INDUSTRY STANDARDS FOR THE PRODUCT AT THE TIME OF INSTALLATION.  ANY DEFECTS IN WORKMANSHIP OF INSTALLATION FOUND FOR A PERIOD OF TWELVE (12) MONTHS FROM THE START OF INSTALLATION SHALL BE REPAIRED OR REPLACED BY PYRAMID FLOORING SYSTEMS OR THAT PORTION OF PAYMENT RELATED TO FAULTY WORKMANSHIP SHALL BE REFUNDED, AS DETERMINED IN COMPANY’S SOLE DISCRETION.  AS A CONDITION TO THIS LIMITED WARRANTY, CUSTOMER MUST GIVE WRITTEN NOTICE OF CLAIM TO PYRAMID FLOORING SYSTEMS  WITHIN 30 DAYS OF DISCOVERY OF THE DEFECT, NOT TO EXCEED TWELVE (12) MONTHS FROM THE START OF INSTALLATION. ALL REPAIRS MUST BE PERFORMED BY CONTRACTORS DESIGNATED BY PYRAMID FLOORING SYSTEMS WITHIN A REASONABLE TIME AFTER RECEIPT OF NOTICE. THIS LIMITED WARRANTY IS FURTHER SUBJECT TO TERMS, CONDITIONS AND LIMITATIONS SET FORTH BELOW (“TERMS OF WARRANTY”),  ALSO AVAILABLE ON  PYRAMID FLOORING SYSTEMS WEBSITE AT WWW.PYRAMIDFLOORINGSYSTEMS.COM.
PYRAMID FLOORING SYSTEMS LIMITED WARRANTY DOES NOT COVER DAMAGE OR DEFECTS NOT CAUSED FROM THE WORKMANSHIP IN INSTALLATION AS MORE SPECIFICALLY DESCRIBED BELOW IN THESE TERMS OF WARRANTY.  PRODUCTS, MATERIALS AND MERCHANDISE USED IN THE INSTALLATION (“PRODUCTS”) BY PYRAMID FLOORING SYSTEMS ARE LIMITED TO AND COVERED EXCLUSIVELY BY THE WARRANTY PROVIDED BY THE MANUFACTURERS OR SUPPLIERS OF THE PRODUCTS, IF ANY. DEFECTS IN THOSE PRODUCTS ARE NOT INCLUDED OR COVERED IN  PYRAMID FLOORING SYSTEMS LIMITED INSTALLATION WARRANTY, UNLESS SPECIFICALLY PROVIDED BELOW.  ANY CLAIM OF WARRANTY ARISING FROM DEFECTS IN THE PRODUCTS MUST BE MADE WITH THE MANUFACTURER OR SUPPLIER OF THE PRODUCT.  THIS LIMITED INSTALLATION WARRANTY IS EXCLUSIVE AND IN LIEU OF ALL OTHER WARRANTIES PROVIDED BY PYRAMID FLOORING SYSTEMS, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO ANY WARRANTY OF MERCHANTABILITY, HABITABILITY, WORKMANSHIP OR FITNESS FOR A PARTICULAR PURPOSE, ETC., ALL OF WHICH ARE HEREBY DENIED BY PYRAMID FLOORING SYSTEMS AND WAIVED BY CUSTOMER TO THE FULLEST EXTENT ALLOWED BY LAW.
CUSTOMER ALSO WAIVES ANY CLAIMS AGAINST PYRAMID FLOORING SYSTEMS AND ITS INSTALLERS FOR LOSS OF USE, LOST REVENUE, INDIRECT, INCIDENTAL OR CONSEQUENTIAL, PUNATIVE OR EXEMPLARY DAMAGES RELATING TO THE INSTALLATION, PRODUCTS, MATERIALS, PROJECT, AND/OR THIS AGREEMENT.   NO WARRANTY PROVIDED HEREIN SHALL BE EFFECTIVE UNTIL AND UNLESS PAYMENT FOR SERVICES IS RECEIVED IN FULL FROM CUSTOMER WITHIN SIXTY (30) DAYS OF SUBSTANTIAL COMPLETION OF INSTALLATION.
As a condition to any obligation under this warranty, Customer must give written notice of claim to Pyramid Flooring Systems, Inc. 624 Cantrill Dr. Davis, Ca  95618,  Attention: Warranty Department, within 30 days of discovery of a defect, not to exceed twelve (12) months from the start of installation. Other conditions and instructions regarding Pyramid Flooring Systems Limited Installation Warranty as well as changes may be provided to Customer by posting on its website, www.pyramidflooringsystems.com

GENERAL TERMS, CONDITIONS AND LIMITATIONS OF PYRAMID FLOORING SYSTEMS LIMITED WARRANTY

The Pyramid Flooring Systems Limited Installation Warranty (“Limited Warranty”) and any warranty referenced in the Pyramid Flooring Systems Promise are subject to the following terms, conditions, and limitations:

• The Limited Warranty applies only to Products set forth in Customer’s order which were installed in owner-occupied residential space where no commercial activity takes place and specifically excludes any Products or installation that has been put into any commercial use. For purposes of this Limited Warranty, the terms “commercial activity, application or use” shall mean any activity or application engaged in for any business purposes (profit or non-profit), regardless of where such activity or application takes place, including but not limited to, such activity or application located in a store, office, warehouse, plant, facility, or other place of business or residential dwelling.
• This Limited Warranty applies only to the original residential customer and installation site noted on the Customer Order and is not transferable.
• Some manufacturers and suppliers of products may provide their own warranties.  Defects in the Products will be covered by the manufacturer’s or supplier’s warranty, if any.  Pyramid Flooring Systems Limited Warranty excludes and does not cover defects in Products not caused by its installation.  Review the manufacturer’s or supplier’s packaging, product information or website for warranty information on the Product.
• This Limited Warranty does not cover damage or defects which were not caused by the quality of workmanship in the original installation by Pyramid Flooring Systems Installers.  The following conditions and circumstances are not considered issues arising from the quality of workmanship in the installation and, therefore, not covered by Pyramid Flooring Systems Limited Warranty:
• Defects in Products not caused by the quality of workmanship in the installation.  Product defects are covered solely by the manufacturer’s or supplier’s warranty, if any.
• Damage or defects arising or caused by preexisting or abnormal conditions of property (i.e. foundations shifts, cracks, leaks, etc.), abuse, misuse, casualty losses, neglect or normal wear and tear installation or repairs made by persons other than an authorized contractor of Pyramid Flooring Systems, or normal wear.  Such circumstances include, but are not limited to, water, fire and other damage from plumbing, vandalism, weather, Acts of God and other casualty losses.  “Abuse” is any use of the Product that is unreasonable considering the normal and expected uses of Products in a residence.
• Damage or defects arising from excessive moisture or heat; exposure to extreme heat, dryness or water; erosion, pebbles, sand, or other abrasives; or stains as a result of household, chemical or industrial products (other than manufacturer’s recommended cleaning products).
• Damages or defects resulting from failure to properly use or maintain the Products or flooring in accordance with the manufacturers’ standards, and normal or routine maintenance; failure to adequately protect the Product while moving furniture, appliances and other items over the surface of Product; or damage, including, but not limited to chips, scratches, stains, other abrasive wear or damage, tears, pulls, cuts, pilling, shedding, matting, crushing, shading, pile reversal, burns, pets, etc.
•  Damages or defects arising from installation, modifications or repairs to the Product or original installation performed by anyone not authorized by Pyramid Flooring Systems, including any attachment, accessory or component not authorized by the manufacturer and not included in customer’s order.
• Variations or differences in color, shade, pattern or texture between products and samples or photographs.
• The specifications and standards for Products provided by Pyramid Flooring Systems will vary depending on the Product, type, grade and manufacturer or supplier. Company makes no representation regarding standards or specifications of any product other than provided by the manufacturer or supplier of that Product, unless set forth in writing signed by an officer of Company. To determine specific Product specifications, contact the manufacturer or supplier for that information or other the terms and conditions regarding Products and their warranties.
• Installation of Products outside, open to the elements, or in areas subjected to high levels of sunlight, extreme temperatures and/or moisture are excluded from Pyramid Flooring Systems Limited Warranty.
• This Limited Warranty applies only to the original installations performed by Pyramid Flooring Systems or an Installer authorized by Pyramid Flooring Systems.
• To qualify for repair, replacement, or refund under this Limited Warranty, Pyramid Flooring Systems original sales receipt must be supplied to demonstrate proof of purchase and payment.
• This Limited Warranty applies only if you follow regular and routine maintenance recommended by the manufacturer or supplier. See the manufacturer’s or supplier’s requirements or recommendations for specific information concerning the cleaning methods and maintenance for your specific Product.  Over time, depending on the amount of use, normal traffic and soiling will cause a change in any flooring’s appearance and will not be covered by this Limited Warranty.
• If there is a conflict between these general terms and conditions and the specific terms and conditions of a particular Product, then the terms and conditions of the specific Products shall control.
• The terms of this warranty begins on the date that installation of the Product begins.
• Customer must give written notice of any claims under this warranty within thirty (30) days of discovery of a defect or damage, not to exceed twelve (12) months from the start of installation.
• Written notice of claim must be made through Pyramid Flooring Systems Warranty Department, by mail at 624 Cantrill Dr. Davis, Ca  95618, Attention: Warranty Department
• .
• If customer’s current flooring is suspected of containing asbestos or hazardous materials, customer shall be responsible for the proper removal and disposal of that material as required by law, prior to installation of Products.

• If repairs are necessary due to deficiencies in the workmanship of installation, then repairs will include both material and labor of the portion that needs repair.  If Pyramid Flooring Systems determines, in its sole discretion, to give a refund, then Pyramid Flooring Systems shall reasonably determine the percentage of the total amount paid which is attributable to that portion of the work which was not completed in a workmanlike manner and refund that amount to Customer, not to exceed the total amount paid by Customer.
• All repairs or replacement under this Limited Warranty are to be performed solely by contractors designated by Pyramid Flooring Systems within a reasonable time after receipt of written notice of the claim. Pyramid Flooring Systems shall neither be liable to nor reimburse Customer for repairs or expenses incurred from any person not authorized in advance in writing by Company.  This warranty shall be voided and of no further force or effect in the event Customer or any person other than the designated representative of Pyramid Flooring Systems attempts to remedy any defects in workmanship claimed.
• No Warranty provided herein shall be effective unless payment for services is received in full from Customer within thirty (30) days after substantial completion of installation.
• The terms, conditions and limitations of this Limited Warranty are subject to change by amendment without direct notice other than as posted on Pyramid Flooring Systems website, located at www.pyramidflooringsystems.com
• Pyramid Flooring Systems limited installation warranty shall never exceed the “life of the Product.”  Life of the Product, if any, shall be that period or length of time specified by the manufacture or supplier as the normal length of time the product should reasonably perform under normal circumstances of use. (See the manufacturer’s specifications and warranty Information for further details on the Product’s packaging or website.)
• Customer shall remove and secure all valuables (including, but not limited to money, checks, jewelry, art, electronics, and other valuable items) from the rooms where the installation or repairs are to take place before installation begins.  Patina shall not be responsible for loss or damage to any such items remaining in the room during installation or repairs.
• UNDER NO CIRCUMSTANCES SHALL PYRAMID FLOORING SYSTEMS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES BASED UPON THE FOREGOING WARRANTIES, CONTRACTS, NEGLIGENCE, STRICT LIABILITY, OR ANY OTHER LEGAL CLAIM BY CUSTOMER OR ANY INVITEE ON CUSTOMER’S PROPERTY.
• Some states do not allow limitations on how long an implied warranty lasts or the exclusion of incidental or consequential damages, so the above limitation or exclusion may not apply to you, if prohibited in your state.  These Terms of Warranty give you specific legal rights, and you may have other rights that vary from state to state.
• Unenforceability of any provision in the Terms of Warranty shall not affect the enforcement of any other provisions herein.  If any term is found unenforceable by a court of competent jurisdiction, then that provision shall be modified by the Court to the extent necessary to make it enforceable.

ADDITIONAL TERMS, CONDITIONS AND LIMITATIONS APPLICABLE TO SPECIFIC PRODUCTS

In addition to the above General Terms, Conditions and Limitations of this Limited Warranty, the following Products have additional specific terms, conditions and limitations that apply to that specific Product, unless otherwise stated.

CARPET & CUSHIONS

• The industry standard for carpets, cushions (also referred to as “pad) and installation of carpet and cushions is the Carpet and Rug Institute (“CRI”).  Information regarding the CRI can be found on its website located at www.carpet-rug.org.
• Area rugs are not covered by Pyramid Flooring Systems Limited Warranty and are thus excluded.
• See carpet and cushion manufacturers’ or suppliers’ separate warranties for the terms and conditions of those Products’ warranties. Each carpet manufacturer has its own definitions and limitations with regard to stain, soil, wear, and static resistance.
• All carpet must be installed over new and proper cushion that meets the HUDUM 72A, Class 1 standards (USA). If customer selects a cushion that does not meet these requirements, then Pyramid Flooring Systems Limited Warranty shall be voided and of no effect, even if installed by Pyramid Flooring Systems.
• No replacement will be made with respect to carpet that has been glued down.  Abnormal matting, crushing, or loss of texture retention from normal foot traffic is defined under standard rating scales and definitions by each fiber manufacturer or carpet manufacturer, as the case may be.  Normal wear and tear is not considered a defect in the installation covered by Pyramid Flooring Systems Limited Warranty.

• Most manufacturers of carpet require the carpet to be professionally cleaned and maintained with a hot water extracted method by an IICRC certified cleaner at least once every 18-24 months in order to maintain the Product’s manufacturer’s warranty coverage.   Coverage under Pyramid Flooring Systems Limited Warranty also requires you to follow the regular carpet care and routine maintenance program required by the manufacturer as a condition to this warranty.
• Most carpets are not intended for use in very high moisture areas such as bathrooms, kitchens, outdoors, etc. This limited warranty does not apply to carpet installed in high moisture areas.
• Over time, normal foot traffic and soiling of a carpet will cause a change in any carpet’s appearance.  Wear or damage from tears, pulls, cuts, pilling, shedding, matting, crushing, shading, pile reversal, burns, pets, improper cleaning, or defective construction is specifically excluded from Pyramid Flooring Systems Limited Warranty.
• Please note that in most installations, seams are necessary. Although Pyramid Flooring Systems installers are trained to minimize seams and their appearance, seams will likely be visible after installation.  This is quite normal, should be expected, and is not considered a defect under Pyramid Flooring Systems Limited Warranty.
• If any carpet installation requires repair, the cushion will not be replaced, unless damage arose from the original installation or as a result of the repairs.

TILE AND NATURAL STONE INSTALLATION

• The industry standard for tile and its installation is the Tile Council of North America (“TCNA”).  Information regarding TCNA can be found on its website located at www.tileusa.com.
• Many flooring and other products available from Pyramid Flooring Systems are made with natural materials, such as stone, granite, marble, limestone, travertine, quartz, etc. (“natural stone”).  Categories and classifications of natural stone products are identified by their building industry classifications and do not necessarily reflect the geological composition of the material, as they may include other or different geological materials. The industry standard for natural stone and its installation will depend on the material and its application.  For example, the Marble Institute of America (“MIA”) is the industry standard for use and installation of various types of marble products.  Information on the MIA can be found at www.marble-institute.com.  Please contact your Pyramid Flooring Systems representative for other natural stone sites.
• Pyramid Flooring Systems Limited Warranty does not apply to damage from exposure to extreme heat, dryness or water saturation, stains, or exposure to chemical products (other than manufacturer’s recommended cleaning products). Nor does this limited warranty cover, in any way, stains to grout, caulk, or any other material adhering to the tile or natural stone.
• This limited warranty excludes any issues related to the Product or grout and adhesives from improper sub floor, sub floor movement, slabs or other foundation or structural issues with the structure.
• This limited warranty does not cover chips, scratches, stains, or damage caused by the actions of customer or others while walking or moving furniture or appliances across the surface (with or without adequate protection) which may be caused by moisture, erosion, pebbles, sand, or other abrasives or substances on the flooring after installation.
• Due to color variations of Products and/or samples, this Limited Warranty does not apply to variations in colors, shades, patterns or textures, and Pyramid Flooring Systems is not responsible for the failure of any tile products to match (1) samples or product information sheets, (2) flooring products in adjacent space, or (3) other products in the house.
• If only portions of an installation must be repaired or replaced, then only those tiles or natural stones affected will be replaced.  If tile or natural stone from the same production are not available, there may be some variation in color, shade, pattern or texture when replaced.  If replacement of an entire area is necessary, selection of replacement style Products must be from the same type and brand.
• Many natural stone products do not have a warranty from the supplier because they are simply cut or quarried from natural materials.  Natural stone is a product of nature and inherently lacks uniformity.  Each piece may have wide variations in aesthetics, color, shade, finish, tint, hardness, strength, slip resistance, voids, veins, cracks, density, etc. Therefore, samples of natural stone may not be an exact representation of the products you actually receive.  Some of the conditions found in natural stone (i.e. voids, cracks, flaws, mineral deposits, etc.) are inherent characteristics of the product and are not to be considered defects, even if they appear after installation.  In addition, during preparation or installation of these Products other materials may be used to fill voids, cracks or other natural flaws in the Product.  These flaws are not considered defects. Customer accepts all natural stone products “AS IS” with these faults, conditions and flaws, and no change in or damage to the product during or after installation as a result of these latent conditions shall be considered a defect or the responsibility of Pyramid Flooring Systems.
• Some natural stone may not be suitable for your particular uses, needs or tolerance, but that decision is based on individual taste and preferences. Therefore, you agree that Pyramid Flooring Systems shall not be liable in any cause of action resulting from your use of natural stone in any form on your project. Pyramid Flooring Systems and Customer hereby disclaim all warranties by Pyramid Flooring Systems or its installer, express or implied, related to natural stone; specifically any expressed or implied warranty of merchantability or fitness for any particular purpose, except as expressly provided by the manufacturer or supplier of that Product.

HARDWOOD FLOORING

• The industry standard for hardwood and its installation is the National Wood Flooring Association (“NWFA”).  Information regarding NWFA can be found on its website located at www.nwfa.com [previously found at www.nofma.org].
• Wood is a natural product; therefore, variations in its grain, pattern, shades, color and/or texture are normal and are not considered to be an installation related deficiency. Pyramid Flooring Systems Limited Warranty does not warrant the product against variations in the pieces of the Product (i.e. grain, pattern, shades, color and/or texture) in the installation.  Proper installation of wood flooring does not require matching of all grains, colors, shades or textures in the pieces or panels used in installation.
• Wood flooring will continue to expand and contract after installation through heating and non-heating seasons. Properly installed wood floors may consequently experience some separation between the boards at different times during the year. Periodic and temporary separations are not considered a product or installation defect or fault that is covered by Pyramid Flooring Systems Limited Warranty.  Installation of wood flooring requires acclimation to the climate in accordance with the manufacturer’s recommendations.  Delays in installation may be necessary to accomplish such acclimation. Inability to acclimate to the environment is a Product warranty and not an installation warranty covered by Pyramid Flooring Systems.
• This Limited Warranty does not apply to damages from exposure to extreme heat, dryness, stains or water saturation. They do not apply to insects, erosion, pebbles, sand, other abrasives, or stains as a result of foot traffic, moving of furniture, chemical or other substances (other than manufacturer’s recommended cleaning products), including iodine and permanent markers. Nor does this limited warranty cover, in any way, stains to Product or any other material adhering to the wood that occur after installation.
• Due to color variations of product and/or samples, the Limited Warranty does not apply to variations in color or shade and Pyramid Flooring Systems is not responsible for the failure of any hardwood flooring product to match (1) samples or product information sheets, (2) flooring products in adjacent space, or (3) other wood products, such as cabinets, stair railings, trim, and moldings.
• Gloss reduction in wood flooring is considered normal wear and tear and not an installation defect. Therefore, such wear is not covered by Pyramid Flooring Systems Limited Warranty.
• Custom installations of any wood floor installed with patterns, medallions, or a border are excluded from Pyramid Flooring Systems Limited Installation Warranty, unless the defect is brought to the attention of Pyramid Flooring Systems within thirty (30) days of substantial completion of installation.

LAMINATE FLOORING

• The industry standard for laminate flooring and its installation is the North American Laminate Floors Association (“NALFA”).  Information regarding NALFA can be found on its website located at www.nalfa.com.
• This Limited Warranty does not apply to damages from exposure to extreme heat, dryness or water saturation, or stains as a result of chemical or industrial products (other than manufacturer’s recommended cleaning products). Nor does this limited warranty cover stains to Products or material adhering to the Product that occur after installation.
• This Limited Warranty excludes any issues related to damages resulting from sub floor, slabs, or other foundation defects or movement.
• If only portions of an installation must be repaired, then only those Products affected will be replaced.  If Product from the same production is not available, there may be some variation in color or shade when replaced.  If replacement of Product is necessary, selection of replacement style Products must be from the same type or brand of Products.  Variations in its pattern, shades, color and/or texture are normal and are not considered to be installation related deficiencies. Pyramid Flooring Systems Limited Warranty does not warrant the product against such variations in pattern, shades, color and/or texture in the installation.
• Due to color variations of product and/or samples, the limited warranty does not apply to variations in color or shade and Pyramid Flooring Systems is not responsible for the failure of any laminate flooring product to match (1) samples or product information sheets, (2) flooring products in adjacent space, or (3) other parts of the property, such as cabinets, trim, moldings, etc.
